COMES NOW the State of Idaho, by and through the Latah County Prosecuting Attorney, and respectfully requests that the Court schedule a hearing on the Defendant's " Motion to Unseal Defendant's Motion to Reconsider Orders Denying Motions to Dismiss the Indictment and in the Alternative for Permissions to Appeal from Interlocutory Orders " filed herein on January 12, 2024. Based on communications with Counsel and the Court, the State understands that Court and Counsel are available for such a hearing on Tuesday, January 23, 2024, at 4:30 p.m.

REQUEST FOR A CLOSED HEARING 1

Because the Court and the State have a legal obligation and responsibility, found both in statute and applicable court rule, to protect the integrity and secrecy of the Grand Jury proceedings, the State respectfully requests that the hearing on the Defendant's said motion be closed so the parties can fully address the merits of their respective arguments related to the Grand Jury for the record.
