Court noted defendant is in Latah County custody. Court identified counsel for both the State and Defendant. 9:10 Court introduced itself to all parties both present in the courtroom and on Zoom. 9:10 Court informed defendant of his rights as a defendant in a felony criminal case and of the procedures to be followed. 9:12 In response to inquiry from the Court, defendant stated he understood his rights and did not need them explained in any further detail. 9:12 In response to inquiry from the Court, defendant stated he had received a copy of the Indictment, further stating his name, date of birth, and last four digits of his social security number were correct as listed. 9:13 Court informed the defendant of the felony charge against him in Count I, Burglary, in violation of Idaho Code 18-1401, 18-1403, and of the maximum penalty that offense carries upon conviction of up to ten years in the state penitentiary, with a mandatory minimum of one year imprisonment, a $ 50,000 fine, or both, and the defendant may be required to pay restitution for any economic loss. 9:13 Court informed defendant of the felony charge against him in Count II, III, IV, and V, Murder in the First Degree, in violation of Idaho Code 18-4001, 18-4002, 18-4003, 18-4004, and of the maximum penalty each offense carries upon conviction of up life imprisonment in the COURT MINUTES (Criminal) 1 state penitentiary or the death penalty, a $ 50,000 fine, he may be required to pay restitution for any economic loss, and he may be required to pay a $ 5,000 civil penalty to the victim's family. 9:16 Court noted the Indictment was signed on May 16, 2023, by the presiding Grand Juror. 9:18 In response to inquiry from the Court, defendant stated he understood all five charges, potential penalties for each charge, and his rights. 9:19 In response to inquiry from the Court, Ms. Taylor stated defendant will stand silent at this time. Court entered Not Guilty pleas for each charge. 9:19 Court informed all parties the State has sixty days to file Notice of whether they intend to pursue the death penalty and defendant has a constitutional right to a speedy trial. 9:19 Ms. Taylor moved to set this case for jury trial towards the end of the speedy trial deadline. Mr. Taylor noted speedy trial runs on approximately November 22, 2023. Ms. Taylor suggested Court set an October Trial date, further stating it will take at least four weeks, possibly six weeks, to try the case. 9:21 Mr. Thompson agreed to an October trial date. 9:22 There being no objection, Court set a Jury Trial to commence on October 2, 2023, for six weeks. 9:22 In response to inquiry from Court, neither counsel had any further matters to address at this time. 9:23 Court clarified the Preliminary hearing set for June 26, 2023, was vacated following the indictment.
