COMES NOW the State in the above-titled matter and submits the following supplemental rebuttal disclosure to the “ Defendant's Supplemental Response to Request for Discovery Regarding Expert Witnesses ” filed on January 23, 2025 (and consistent with the Court's May 6, 2025, “ Order on State's Motion for §18-207 Examination and Extension of Deadline ").

It is anticipated the State may call Dr. Jason D. Gage to offer rebuttal testimony at the penalty phase of the trial. If the Defendant opens the door to rebuttal testimony during the guilt phase the State would offer Dr. Gage's testimony prior pursuant to Rule 702, 703, or 705 of the Idaho Rules of Evidence. The State is attaching Dr. Gage's: (1) “ Independent Neuropsychological Evaluation ” as Exhibit S-1; and (2) Curriculum Vitae as Exhibit S-2 (both filed under seal) DATED this 27th day of May 2025.
