THOMPSON, JR., ISB No. 2613 PROSECUTING ATTORNEY ASHLEY S. JENNINGS, ISB No. 8491 SENIOR DEPUTY PROSECUTING ATTORNEY JOSHUA D. HURWIT, ISB. No. 9527 SPECIAL DEPUTY PROSECUTING ATTORNEY Latah County Courthouse 522 S. Adams Street, Ste. 211 Moscow, ID 83843 Phone: (208) 883-2246 paservice@latahcountyid.gov IN THE DISTRICT COURT OF THE FOURTH JUDICIAL DISTRICT OF THE STATE OF IDAHO, IN AND FOR THE COUNTY OF ADA STATE OF IDAHO, Case No. CR01-24-31665 Plaintiff, STATE'S RESPONSE TO V. COALITION OF MEDIA ORGANIZATION'S MOTION TO BRYAN C. KOHBERGER, BE HEARD AS INTERESTED Defendant. PARTIES AND MOTION TO VACATE NONDISSEMINATION ORDER COMES NOW the State of Idaho, by and through the Latah County Prosecuting Attorney, and responds to a coalition of media organization's Motion To Be Heard as Interested Parties and Motion to Vacate Nondissemination Order (the “ Motion ”). As set forth below, the State will not oppose the Motion. The Defendant pleaded guilty on July 2, 2025, to all charges in this case. At the change of plea hearing, the Court asked the parties for their position on whether the Nondissemination Order in this case should be maintained. The State requested — and the Court granted the request for the Nondissemination Order to remain in effect through sentencing. STATE'S RESPONSE TO COALITION OF MEDIA ORGANIZATION'S MOTION TO BE HEARD AS INTERESTED PARTIES AND MOTION TO VACATE NONDISSEMINATION ORDER 1 Upon further reflection, the State withdraws its request. Now that the Defendant has pleaded guilty as charged to all five (5) counts of the Indictment, his right to a fair trial on the issue of guilt is no longer at issue. Nevertheless, out of respect for the integrity of the judicial process and the privacy of the victims and their families as they consider their rights to provide victim impact statements at sentencing, the prosecution team does not intend to make any public statements about this case until after sentencing has concluded. RESPECTFULLY SUBMITTED this 14th day of July 2025. William W.
