Interested Parties.

On July 2, 2025, Brian Kohberger pled guilty to the murders of four University of Idaho students and to one count of burglary. Mr. Kohberger's plea sharply changed the Sixth Amendment fair trial / First Amendment balance in this case and has rendered the primary justification for sealing records in this case moot. Indeed, the infringement on the First Amendment rights of the media and public through the voluminous sealing of records in this case is no longer justifiable, nor does it comport with Idaho Court Administrative Rule 32.

Rule 32 expressly allows for a " non-part [y] whose rights are affected by or who otherwise have a right to access information contained in a court file, may move to unseal records in a case file. " I.C.A.R. 32 (i) (1). Dist., 172 Idaho 113, 121, 529 P.3d 1259, 1267 (2023) (“ [B] oth state and federal courts often permit the media to intervene in criminal cases on a limited basis — or at least file a motion as interested parties in the defense of public access and free speech, including in Idaho. ”). The Media Coalition further requests the opportunity to present oral argument on this issue at the Court's earliest available opening.2 This Motion is supported by the accompanying memorandum and the Declaration of Rebecca Boone in Support of Motion to be Heard and Unseal Records.

The Media Coalition recognizes that this is a different motion even though it involves overlapping issues and will likely require its own separate hearing. If the Court deems it proper, however, the Media Coalition will be prepared to discuss this motion during the July 17 hearing.
