) Defendant.) On June 15, 2023, Defendant Bryan C. Kohberger (" Kohberger ") filed Defendant's Second Motion to Compel Discovery. Oral argument on the Motion was heard on June 27, 2023. Kohberger was represented by Anne Taylor and Jay Logsdon, Kootenai County Public Defender's Office and Elisa Massoth. The State was represented by William Thompson, Jr., and Ashley Jennings, Latah County Prosecutor's Office, and Ingrid Batey and Jeff Nye, Office of the Attorney General.

At the outset of the hearing, the parties informed the Court that they had reached agreements on all issues except Requests 1, 4, and 109. During the hearing, the State represented that they are working with the FBI to obtain the information requested and would be providing it to the defense once it was received and reviewed. The defense moved the Court to impose a deadline for the materials to be turned over to the Court. The parties agreed that July 14, 2023, was reasonable.

MOTION TO COMPEL DISCOVERY-1

THEREFORE, THE COURT ORDERS THE FOLLOWING:

The State shall provide to the defense the materials requested in Requests 1, 4, and 109 of Defendant's Second Motion to Compel Discovery no later than July 14, 2023, unless the State demonstrates good cause for an extension of time to turn over the requested material.
