Defendant.) CONFERENCE ) Based on the status conference held on August 23, 2023, the media's Motion to Intervene and Motion to Continue Hearing filed on August 30, 2023, and the agreement of the parties, the Court orders the following:
1) The hearing on Defendant's Motion to Remove Cameras from the Courtroom scheduled for
1:00 p.m. on September 1, 2023, is vacated.

2) A scheduling conference will be conducted by Zoom on September 1, 2023, at 1:00 p.m.

The parties and counsel for the media will appear by Zoom. Courtroom # 3 of the Latah County Courthouse will be open to the public for those who would like to sit and listen to the scheduling conference. At that time, a new hearing date for Defendant's Motion to Remove Cameras from the Courtroom will be set.

3) The hearing on Defendant's Motion to Dismiss Indictment originally scheduled for

VACATING TRIAL; VACATING SCHEDULING ORDER;

AND SETTING SCHEDULING CONFERENCE-1

September 1, 2023, at 1:00 p.m. is reset to September 22, 2023. Defendant's Motion to Dismiss Indictment on Grounds of Biased Grand Jury, Inadmissible Evidence, Lack of Sufficient Evidence, and Prosecutorial Misconduct in Withholding Exculpatory Evidence will be heard at 10:30 a.m. Based on the stipulation of the parties, the hearing will be sealed to protect the privacy of the grand jurors. Defendant's Motion to Dismiss Indictment on Grounds of Error in Grand Jury instructions or in the Alternative Remand for Preliminary Hearing will be heard at 1:00 p.m. and will be open to the public.

4) The jury trial is set to commence at 8:30 a.m. on October 2, 2023, is vacated.

5) The Scheduling Order dated August 18, 2023, nunc pro tunc to August 22, 2023, is vacated.
