James of the firm James, Vernon & Weeks, P.A., and based upon the Verified Complaint, the declarations in support of this motion, and the supporting memorandum filed herein, and in accordance with I.R.C.P. 65 (b), hereby respectfully moves the above-entitled Court ex parte for issuance of a temporary restraining order restraining the CITY OF MOSCOW from disseminating any further information protected from disclosure under the Idaho Public Records Act. Plaintiff's Counsel certifies he attempted to resolve this matter with the CITY OF MOSCOW, through its attorney, before filing this Motion. The City's Attorney provided Plaintiff the professional courtesy of notifying Plaintiff that she is authorized to accept service of pleadings by email. Plaintiff's Counsel further certifies that he gave the City's Attorney notice that this EX PARTE MOTION FOR TEMPORARY RESTRAINING ORDER: 1 Motion would be filed and, upon filing it, emailed her a copy.
